Terms of Service

Aux Battles (the “Service”) is a free multiplayer music game you play in your browser at auxbattles.app. It is run by Emilis Mikalajunas, an individual based in Lithuania (“we”, “us”). By using the Service you agree to these Terms. If you don’t agree, please don’t use it.
1. The game is free, with no accounts
Aux Battles is completely free. There are no accounts to create and no payments of any kind. You join a regular room with a 4-letter code and a display name you choose; behind the scenes your browser gets an anonymous session so the game can keep you in your room. Twitch Battles and friends battles are the exception, described below.
1b. Twitch Battles and friends battles
Twitch Battles let a streamer connect a Twitch channel so their live chat can vote and submit songs alongside the room. Hosting, submitting through a submit link, requesting a seat in a friends battle, or using mod-view requires signing in with your own Twitch account in good standing, through Twitch’s own login. See our Privacy Policy for what that shares with us. Voting by typing a number in chat needs no login at all. You can disconnect a linked Twitch account at any time from the room lobby.
If you are the streamer, your stream is yours: you are responsible for what you broadcast, including the music, and for following Twitch’s Terms of Service, Community Guidelines and music and copyright rules. Aux Battles gives you no licence to broadcast any song, and playing copyrighted music on a stream can lead to muted VODs or strikes on your channel. You decide which chat submissions are played and who wins, and you are responsible for removing anything inappropriate your chat sends.
2. Who can play
You must be at least 13 years old to use the Service. If you are in the European Economic Area (EEA) or the UK and under 16, you need permission from a parent or guardian. Signing in with Twitch also requires meeting Twitch’s own age requirements. By using the Service you confirm you meet these requirements.
3. Content you submit
During a game you submit a display name, song links and, optionally, prompts and feedback. You are responsible for what you submit. Don’t use display names or content that are hateful, harassing, sexually explicit, illegal, that infringe someone else’s rights, or that impersonate someone else.
You keep whatever rights you have in what you submit. You give us permission to store it and show it to the other players in your room for as long as the room exists, and to keep prompts you invent (without your name) so they can be suggested to other players.
Because rooms are temporary and anonymous, we generally can’t moderate in real time, so treat the people you play with the way you’d want to be treated.
3b. Reporting illegal content, and how we moderate
If you see content on Aux Battles that you believe is illegal or breaks these Terms, email mikalajunas.emilis@gmail.com with the subject “Report”. Tell us where it is (the room code or page address), what it is, why you think it is illegal or against these Terms, and, unless you are reporting child sexual abuse material, your name and email. We review every report by hand, act on it without undue delay, and tell you what we decided.
We may remove content, close a room, or restrict access for anyone who breaks these Terms or the law. Where we do and can reach you, we’ll tell you what we did and why, and you can reply to the same address to ask us to reconsider. We don’t use automated moderation. The same address is our single point of contact for users and for authorities under the EU Digital Services Act, and we handle messages in English or Lithuanian.
4. Music, Spotify, YouTube, SoundCloud, Deezer and Twitch
Aux Battles does not host, stream, or own any music. Songs play through Spotify, YouTube, or SoundCloud, depending on the sources the room has enabled, each through its own embedded player in the page, and song search may also use Deezer. No Spotify Premium account or app install is required to play; a Spotify account logged into that browser plays the full track instead of a preview clip. Your use of Spotify, YouTube, SoundCloud, Deezer or Twitch is governed by that service’s own terms and privacy policy, and we’re not responsible for them.
Aux Battles uses YouTube API Services. By using the YouTube features of the Service you agree to be bound by the YouTube Terms of Service, and Google’s Privacy Policy applies to them.
Spotify, YouTube, SoundCloud, Deezer and Twitch are trademarks of their respective owners. Aux Battles is an independent project and is not affiliated with, endorsed by, or sponsored by any of them.
5. Acceptable use
Don’t abuse the Service: no attempting to break, overload, scrape, or reverse-engineer it; no automated flooding of rooms or chat; no using it to send spam or malware links; and nothing that interferes with other players’ games. We may restrict or block access if you do.
6. Copyright complaints
The Service only links to and embeds songs hosted by the music services above, so a complaint about a song itself is best sent to the service that hosts it. If you believe something that lives on Aux Battles (text, an image, a prompt or a display name) infringes your copyright, send the details to mikalajunas.emilis@gmail.com as described in section 3b and we’ll remove it if the complaint is valid.
7. No warranty
The Service is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. It’s a free hobby project: it may go down, lose data, or change at any time. We don’t promise it will be uninterrupted, error-free, or that rooms and scores will be preserved.
8. Limitation of liability
To the fullest extent allowed by law, Aux Battles and its creator won’t be liable for any indirect, incidental, or consequential damages arising from your use of (or inability to use) the Service, including anything that happens to a Twitch channel as a result of music played on it.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, for damage caused intentionally or by gross negligence, or any other liability that cannot be limited under the law that applies to you.
9. Image usage and licensing
The illustrated cards on this site (the 1200×630 images on the prompt, song list and guide pages) are created by Aux Battles and we own the rights to them.
You may reuse them unchanged for editorial, review, or press coverage of Aux Battles, as long as you credit “Aux Battles” and link back to auxbattles.app. You may not sell them, crop or alter them, or use them in any way that suggests Aux Battles endorses your product or service.
Album artwork shown on the song list pages is not ours. It is supplied by Spotify and belongs to the respective rights holders; the permission above does not cover it.

10. Ending your use
You can stop using the Service at any time; your game data is deleted on the schedule in the Privacy Policy. We may suspend or stop the Service, or your access to it, at any time, for example if you break these Terms.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll change the “Last updated” date above, and if a change materially affects you we’ll say so on the site. Continuing to use the Service after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Lithuania, without regard to conflict of law rules, and disputes go to the courts of Lithuania. If you are a consumer, you keep the protection of the mandatory laws of the country you live in, and you can also bring a claim in the courts there.
13. General
If any part of these Terms is found unenforceable, the rest still applies. Not enforcing a part of these Terms is not a waiver of it. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
